{"id":1028,"date":"2025-09-18T15:39:01","date_gmt":"2025-09-18T14:39:01","guid":{"rendered":"https:\/\/www.digivance.nl\/?page_id=1028"},"modified":"2026-02-25T14:12:10","modified_gmt":"2026-02-25T13:12:10","slug":"algemene-voorwaarden","status":"publish","type":"page","link":"https:\/\/www.digivance.nl\/en\/algemene-voorwaarden\/","title":{"rendered":"Terms And Conditions"},"content":{"rendered":"<p class=\"wp-block-paragraph\">These general terms and conditions apply to all services, offers and Agreements of Digivance.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h4 class=\"wp-block-heading\"><strong>Article 1-Definitions<\/strong><\/h4>\n\n\n\n<p class=\"wp-block-paragraph\">\u2022 <strong>Digivance:<\/strong> contractor, reachable via <a>info@digivance.nl<\/a> and + 31 6 10797143<br>\u2022 <strong>Client:<\/strong> any natural or legal person who enters into an agreement with Digivance<br>\u2022 <strong>Agreement:<\/strong> every agreement between Digivance and the client regarding services<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h4 class=\"wp-block-heading\"><strong>Article 2-Applicability<\/strong><\/h4>\n\n\n\n<ol class=\"wp-block-list\">\n<li>These terms and conditions apply to all offers, quotations and Agreements of Digivance.<\/li>\n\n\n\n<li>Deviations are only valid if agreed in writing.<\/li>\n\n\n\n<li>Any conditions of the client are expressly excluded.<\/li>\n<\/ol>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h4 class=\"wp-block-heading\"><strong>Article 3-quotations and agreements<\/strong><\/h4>\n\n\n\n<ol class=\"wp-block-list\">\n<li>Quotations are without obligation unless otherwise stated.<\/li>\n\n\n\n<li>An agreement is concluded after written or electronic confirmation by Digivance.<\/li>\n\n\n\n<li>Digivance reserves the right to refuse an assignment without giving reasons.<\/li>\n<\/ol>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h4 class=\"wp-block-heading\"><strong>Article 4 - performance of services<\/strong><\/h4>\n\n\n\n<ol class=\"wp-block-list\">\n<li>Digivance carries out work on the basis of an effort obligation.<\/li>\n\n\n\n<li>Results such as revenue growth, ranking positions or conversions cannot be guaranteed.<\/li>\n\n\n\n<li>The client provides all necessary information, content and access in a timely manner.<\/li>\n\n\n\n<li>Delay due to missing input is at the expense of the client.<\/li>\n<\/ol>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h4 class=\"wp-block-heading\"><strong>Article 5-prices and payment<\/strong><\/h4>\n\n\n\n<ol class=\"wp-block-list\">\n<li>All prices include VAT unless otherwise stated.<\/li>\n\n\n\n<li>Payment must be made within 14 days of the invoice date.<\/li>\n\n\n\n<li>In the event of late payment, statutory interest and collection costs are due.<\/li>\n\n\n\n<li>Digivance may suspend work in the event of late payment.<\/li>\n<\/ol>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h4 class=\"wp-block-heading\"><strong>Article 6-Terms and delivery<\/strong><\/h4>\n\n\n\n<ol class=\"wp-block-list\">\n<li>Stated timeframes are estimates and are not binding deadlines.<\/li>\n\n\n\n<li>Exceeding does not entitle to compensation or dissolution.<\/li>\n<\/ol>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h4 class=\"wp-block-heading\"><strong>Article 7-Hosting and domains<\/strong><\/h4>\n\n\n\n<ol class=\"wp-block-list\">\n<li>Digivance works with third-party hosting providers.<\/li>\n\n\n\n<li>Digivance is not liable for malfunctions, downtime or data loss by third parties.<\/li>\n\n\n\n<li>Backups and security will only be provided if agreed.<\/li>\n<\/ol>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h4 class=\"wp-block-heading\"><strong>Article 8-intellectual property<\/strong><\/h4>\n\n\n\n<ol class=\"wp-block-list\">\n<li>All developed websites, designs, texts and software remain the property of Digivance until full payment has been made.<\/li>\n\n\n\n<li>After payment, the client receives a right of use.<\/li>\n\n\n\n<li>Digivance may use Work For portfolio and promotion purposes.<\/li>\n<\/ol>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h4 class=\"wp-block-heading\"><strong>Article 9-Liability<\/strong><\/h4>\n\n\n\n<ol class=\"wp-block-list\">\n<li>Digivance is only liable for direct damage caused by intent or gross negligence.<\/li>\n\n\n\n<li>Liability is limited to the invoice amount of the relevant service.<\/li>\n\n\n\n<li>Digivance is not liable for indirect damage such as loss of profit, loss of data or damage to reputation.<\/li>\n<\/ol>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h4 class=\"wp-block-heading\"><strong>Article 10-duration and termination<\/strong><\/h4>\n\n\n\n<ol class=\"wp-block-list\">\n<li>Ongoing services have a notice period of 1 month.<\/li>\n\n\n\n<li>Digivance may terminate the agreement in the event of default or misuse.<\/li>\n\n\n\n<li>Work already done remains due.<\/li>\n<\/ol>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h4 class=\"wp-block-heading\"><strong>Article 11-Force Majeure<\/strong><\/h4>\n\n\n\n<p class=\"wp-block-paragraph\">Digivance is not liable for delay or damage caused by force majeure, including:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">* malfunctions<br>* internet outage<br>* hacking attacks<br>\u2022 government measures<br>\u2022 disease<br>\u2022 natural disasters<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h4 class=\"wp-block-heading\"><strong>Article 12 -
